Tester Calls on Senate to Reject Alito Nomination

Judge’s Track Record Raises Too Many Questions, Candidate Says

U.S. Senate candidate Jon Tester today called on the Senate to reject Samuel Alito’s nomination to replace Sandra Day O’Connor on the U.S. Supreme Court.

“There are simply too many reasons to doubt this nomination and not enough reasons to have faith in it,� said Jon Tester. “When applying for a job, Judge Alito made it clear that he disagreed legally with such fundamental Constitutional principles as the right of one person, one vote. Without the fundamental belief in America that we are all created equal under the law, we can have no justice.

“I’m also deeply disappointed by Judge Alito’s broken promises to the U.S. Senate. When confirmed to sit on a circuit court, Judge Alito said that he would recuse himself from cases involving certain parties where he had a vested interest. He failed to do that.

“Here in the West, our word is our bond and a promise and a handshake mean something. This is President Bush’s second nomination to replace a Western justice with one from the East Coast. I think we need more Western common sense and ethics on the Supreme Court, not less. I think the U.S. Senate needs to reject the nomination of Samuel Alito.�

Jon Tester is a farmer from Big Sandy, MT, and currently serves as President of the Montana Senate. He is running for the Democratic nomination for U.S. Senate, for the seat currently held by Republican Conrad Burns.
